These Standard Terms are effective from August 2014 and supersede all previous Standard Terms issued. These standard Standard Terms regulate the relationship between Beautiful Bumps Ltd and/or Kiddiwinks. and the Client.
Interpretation
Assignment means the work to be performed or intended to be performed by a Model under these standard terms.
We, Us or Our means Beautiful Bumps Ltd and/or Kiddiwinks. 134 Ridge Langley, South Croydon, CR2 0AS
You or Your means the Client using a Model through Beautiful Bumps Ltd and/or Kiddiwinks.
Introduced, Introduces means the provision by Beautiful Bumps Ltd and/or Kiddiwinks. To Client of any details relating to
. and identifying a Candidate whether written or oral.
Model means the person introduced to the Client by Beautiful Bumps Ltd and/or Kiddiwinks.
Confirmation means information sent to the Client detailing relevant information for the assignment e.g Location, Date, Time.
Payment Terms means within 30 days from invoice date.
- You agree
That these Standard Terms are deemed to be accepted by the Client from the time Beautiful Bumps Ltd and/or Kiddiwinks. introduces a Model;
To notify Us immediately of its intention to engage a candidate introduced by Beautiful Bumps Ltd and/or Kiddiwinks. or to engage a Candidate on a permanent, contract or temporary basis or otherwise (including through another agency);
That all matters relating to the use of the Model’s image, any other services supplied by the Model and all fees must be negotiated and agreed only with Beautiful Bumps Ltd and/or Kiddiwinks.. If You or any other persons connected with You obtains the Models signature on any document or the Models purported agreement it is not binding until it is agreed in writing by Us.
- Provision of Services
Beautiful Bumps Ltd and/or Kiddiwinks. will use its reasonable endeavours to ensure that Models are efficient, honest and reliable but We give no warranty in this regard;
Model may cancel up to 24 hours prior to the assignment. An exception to this condition is if they have been advised to withdraw from the assignment by a health professional due to health issues. We will try to provide a replacement Model for You, but cannot guarantee this whatsoever;
During the period of an Assignment each Model will be under the Client’s direction, supervision, management, and control as to the manner in which they perform the assignment. The Client is responsible for the health and safety of each Model.
The Client will comply in all respects with all statutes including, for the avoidance of doubt, the Working Time Regulations, codes of practice and other legal requirements and the Client will provide adequate insurance for each Model during the period of an Assignment;
We are not responsible if the model fails to attend any assignment. You are advised to insure against any losses which might be suffered if the Model does not keep to an assignment.
- Payment
The client shall pay Beautiful Bumps Ltd and/or Kiddiwinks. fees (as specified separately in writing to the Client, or as otherwise agreed) for each assignment actually worked by the Model. Beautiful Bumps Ltd and/or Kiddiwinks. will pay each Model. Beautiful Bumps Ltd and/or Kiddiwinks. will invoice the Client after each assignment. Invoices are payable within 30 days from invoice date;
- Insurance
It is Your responsibility to carry out a risk assessment of the location, equipment and the work conditions. Any risk to Health and Safety known to You must be discussed with Us at the time of the booking. You are responsible for the Models safety when the Model is providing services in connection with the assignment. You are responsible for the Models health and safety as if the Model were an employee of You.
5. Miscellaneous
The Client acknowledges and agrees that it is responsible for and will comply with the obligations defined by Regulation 2(1) of the Working Time Regulations 1998 (“WTR”) for the purpose of the WTR in relation to the Models the Client Engages.
The Client agrees that it will use all reasonable endeavours to ensure that Models take the necessary daily rest periods and rest breaks pursuant to Regulations 10, 11 and 12 of the WTR; The Client agrees that it will comply with the provisions of the Data Protection Act 1998 in relation to the personal data of Models whether Supplied to the Client by Beautiful Bumps Ltd and/or Kiddiwinks. or otherwise;
Any cause for complaint should be reported when it arises. Complaints cannot be considered in retrospect.
